On September 28, 2020, Chris Langer filed suit against Equity Lifestyle Properties, Inc.
Contentions
PLAINTIFF'S CONTENTIONS: The plaintiff contended that he had delayed endolymphatic hydrops, which caused him permanent, partial hearing loss; that he relied on subtitles and closed captioning to be able to review the content of recorded audio; that the defendant owns and operates membership campgrounds and RV parks in California. The plaintiff contended the campgrounds and parks operated by the defendant were places of public accommodation; that he visited the defendant's website to look for information about camping grounds and other facilities operated by the defendant; that the video content on the website lacked captioning; and that he encountered difficulty when trying to view the videos. The plaintiff contended that he was deterred from returning to the website because of this; and that the defendant had violated the Americans with Disabilities Act.
DEFENDANT'S CONTENTIONS: The defendant denied any wrongdoing or liability. The defendant contended that, after the complaint was filed, it ensured all its videos on the website were updated to include captions; and that it had not received any other complaints about the lack of captioning.
Result
The court granted summary judgment in favor of the defendant.
