Facts

Zachary James Lutz was a non-exempt employee of Galactic Enterprises, LLC, formerly Virgin Galactic, LLC; and Galactic CO., LLC, formerly TSC, LLC. On September 2, 2021, Lutz filed suit on behalf of himself and on behalf of all others similarly situated against Galactic Enterprises and Galactic CO. in Kern County Superior Court.

Contentions

PLAINTIFF'S CONTENTIONS: The plaintiff contended that the defendants failed to pay minimum wages; failed to pay overtime wages; failed to provide meal periods; failed to provide rest breaks; failed to reimburse necessary business expenses; failed to provide accurate itemize wage statements; failed to pay all wages due upon separation from employment; failed to timely pay wages; violated the Unfair Competition Law; and were liable for civil penalties under the Private Attorneys General Act.

DEFENDANTS' CONTENTIONS: The defendants denied any wrongdoing or liability and all the plaintiff's material allegations.

Result

The parties reached a settlement agreement wherein the defendants admitted no wrongdoing or liability but agreed to pay $1.7 million to settle class and PAGA claims.
