On June 8, 2022, Raquel Caro Santiago and Steve Lopez, individually and on behalf of all others similarly situated, brought a class action against Southwest Key Program (Southwest). The class included all individuals currently or formerly employed by Southwest in California as hourly, non-exempt employees from June 8, 2018, through June 8, 2023. According to defendant's records, Class Members worked a total of 32,325 Workweeks during the Class Period.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendant failed to: pay minimum or overtime wages, timely pay wages, provide accurate itemized wage statements, maintain accurate records, reimburse business expenses, provide meal periods or rest breaks, provide paid sick leave, and post notice of paydays and time and place of payment for its California employees during the relevant time period. Further, plaintiffs alleged that defendant engaged in unfair competition.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions and maintained it fully complied with the law.
Result
Southwest Key Program agreed to pay $350,000 to settle all claims.
