Facts

On December 28, 2021, Vincent Ramsey Jr., individually and on behalf of all others similarly situated, brought a class action against Packaging Corp of America and PCA Central California Corrugated, LLC, alleging various Labor Code violations. The class included all non-exempt employees who worked for Packaging Corporation of America and PCA Central California Corrugated, LLC in California and who were paid overtime and/oft shift differential wages from December 21, 2020, through February 18, 2022. There were approximately 682 individuals that comprised the class period.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended that defendants failed to provide accurate itemized wage statements in violation to the California Labor Code and all applicable Industrial Welfare Commission Wage Orders. Plaintiffs sought to recover penalties pursuant to the California Private Attorneys General Act based on the alleged violations.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Settlement Discussions

On September 28, 2022, the parties participated in a full-day mediation with neutral Michael J. Loeb, Esq., that did not result in settlement. However, the parties continued settlement discussions that ultimately reached an agreement to resolve the action.

Result

Defendants agreed to pay $975,000.
