On October 16, 2019, Carlos Adalberto Mejia, individually and on behalf of all others similarly situated, brought a class action against J.A. Momaney Services Inc. (JAMS), alleging various Labor Code violations. The class included all non-exempt employees employed by JAMS in California at any time from October 16, 2015, through the date of preliminary approval, excluding family members of Jeffrey Momaney.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant failed to: pay minimum and overtime wages, provide meal and rest periods or pay premium compensation in lieu thereof, timely pay wages, pay all wages due at termination, maintain accurate records, and provide accurate wage statements for its California employees during the relevant time period. Further, plaintiff alleged that defendant engaged in unfair competition and unlawful business practices in violations of California Unfair Competition Law and the Business and Professions Code.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
J.A. Momaney Services Inc. agreed to pay $720,000 to settle all claims.
