Facts
Plaintiff, Venice Family Clinic (VFC), was a borrower under Defendant United States Small Business Administration's (SBA) Paycheck Protection Program ("PPP") Loan Program. VFC borrowed approximately $6.67 million in funds, via Comerica Bank, on the basis of it meeting certain eligibility criteria for the PPP Loan Program, including demonstrating that it had payroll costs in 2019. VFC alleged that the SBA improperly denied its loan forgiveness by erroneously concluding that VFC was ineligible to receive a PPP loan because it lacked "payroll costs."
Result
The parties agreed to settle. The SBA issued a Notice of Paycheck Protection Program Forgiveness Payment to VFC for the full loan amount of $6,672,100.00 in principal and $137,519.39 interest.
