Facts

On November 22, 2019, Daisy Arellano filed a class action complaint against Miniso Depot Inc. and its partners and subsidiaries for Labor Code violations in Los Angeles County Superior. Four months later, on March 5, 2020, Stephanie Corona filed a representative action for civil penalties pursuant to the Private Attorneys General Act (PAGA) also against the same defendants as the Arellano action. The two cases were consolidated on April 11, 2022.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs contended, among others that defendants: failed to pay for all hours worked at the minimum wage and/or applicable overtime rates of pay; failed to provide legally compliant meal and/or rest periods nor applicable premium wages; and failed to adequately pay for employment-related losses/expenditures. Moreover, defendants were accordingly liable for statutory, waiting time, civil, and PAGA penalties.

DEFENDANTS' CONTENTIONS: Defendants denied and disputed all contentions asserted. Moreover, they asserted that plaintiffs and class members were compliant with all wage-and-hour claims.

Settlement Discussions

On February 24, 2021, the parties participated in the first mediation session with Judge Carl West. After another mediation session on September 9, 2021, along with subsequent negotiations, the parties reached a settlement.

Result

The case settled for $1.25 million.
