Facts

On March 1, 2022, Claudio Valdez, as an individual and on behalf of all others similarly situated, brought a class action against Labor Fore Management Inc. and Fowler Packing Company Inc., alleging various Labor Code violations. The class included all current and former non-exempt employees of Labor Force Management, Inc. who performed work for Fowler Pakcing Company, Inc. in California at any time from November 13, 2020, through March 17, 2022. Defendants represented there were approxmiately 2,007 Settlement Class Members and approximately 6,046 Class Workweeks within the Class Period.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants failed to: pay minimum wages, pay all overtime wages, provide compliant meal periods, provide compliant rest periods, reimburse for necessary business expenses, and provide accurate itemized wage statements. Further, plaintiff alleged that defendant engaged in unfair competition.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Settlement Discussions

On March 23, 2023, the parties privately mediated the action before the Honorable David R. Lampe (Retired) of Common Ground Solutions. On June 14, 2023, the parties reached an agreement.

Result

Defendants agreed to pay $150,000 to settle the case.
