Published: Dec. 29, 2023 | Result Date: Mar. 27, 2023 | Filing Date: Apr. 16, 2020 |

Case number: 3:20-cv-00736-JLS-WVG Summary Judgment –  Defense

Judge

Janis L. Sammartino

Court

USDC Southern District of California

Attorneys

Plaintiff

Pro Per

Defendant

Anne M. Kammer
(California Department of Justice)

Facts

Plaintiff Richardo Valdez, an incarcerated individual proceeding pro se, alleged that defendants' discontinuation of his pain medication at the Richard J. Donovan (RJD) correctional facility constituted a violation of his Eighth Amendment rights. Defendants moved for summary judgment.

Result

The court granted summary judgment for defendants. It found that Valdez failed to make a sufficient showing to establish that defendant Zhang, a prison physician, was deliberately indifferent to Plaintiff's serious medical needs. Defendant Schobelock, a registered nurse at RJD who interviewed Valdez about his grievance, was protected by qualified immunity, as Valdez had not established a clear violation of his constitutional rights. The case was dismissed.
