Facts

Plaintiff Anthony Ferreiro brought an action against CWI, Inc. and Revo Brand Group holdings, Inc., alleging that defendants violated the Safe Drinking Water and Toxic Enforcement Act of 1986 (aka Proposition 65) by distributing Real Avid Smart Drive Gunsmithing Kits without the requisite warning regarding BPA exposure.

Result

Defendants settled the case, agreeing to add warning labels to the products. They also agreed to pay $1,000 as a civil penalty and $16,500 in attorneys' fees.
