Facts

On July 30, 2021, Alejandro Ferrer, an individual and on behalf of all others similarly situated, brought a class action against Ineos USA LLC and Tony Cockram, alleging various Labor Code violations. The class included all persons currently or formerly employed by defendants in California and classified as non-exempt, hourly-paid employees who worked for defendants from July 30, 2017, through June 5, 2023.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendants failed to: pay overtime wages, pay minimum wages, provide meal periods or compensation in lieu thereof, provide rest periods or compensation in lieu thereof, timely pay wages during employment, indemnify for business expenses, and pay for unused vested vacation time for its California employees during the relevant time period. Further, plaintiff contended that defendants engaged in unfair competition in violation of the California Business & Professions Code.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Settlement Discussions

On December 14, 2022, the parties participated in an all-day mediation presided over by Jeffrey A. Ross, Esquire. At the date of mediation, defendants estimated there were 38 Class Members who collectively worked a total of 7,705 workweeks.

Result

Defendants agreed to pay $300,000 to settle the case.
