On December 29, 2020, Laura Delgado filed suit in Contra Costa Superior against her former employer, Orinda Care Center, alleging wage-and-hour violations. She sought to represent hourly, non-exempt employees who worked at the Center anytime during the period of October 19, 2019 and January 19, 2022.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff asserted that defendant: failed to provide required meal and/or rest periods; failed to pay overtime and/or minimum wages; failed to pay all wages due on termination; failed to maintain required records or furnish accurate, itemized wage statements; failed to indemnify for necessary expenditures; and violated the Private Attorneys General Act.
DEFENDANT'S CONTENTIONS: Defendant denied all liability, asserting that not only has its conduct been lawful during the relevant period but also that plaintiff's claims were meritless.
Result
The case settled for $400,000.
