Facts

On August 7, 2020, Calvin Hong, on behalf of himself and all other similarly situated individuals, brought a putative class action against Analog Devices Inc. On December 14, 2022, Hong filed a Second Amended Complaint adding a cause of action for violations of the Private Attorneys General Act. The class included all current and former non-exempt employees in California beginning April 6, 2016, through December 31, 2022, unless shortened at Defendant's option pursuant to Section III(C)(5) of the settlement agreement, excluding those former employees who signed separate individual severance and release agreements covering the claims alleged in this matter.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: compensate employees for off-the-clock work, properly round their work time, provide required meal and rest periods, timely pay final wages, provide accurate itemized wage statements, properly calculate overtime and sick leave pay, and reimburse business expenses for its nonexempt California employees during the class period.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Settlement Discussions

On August 13, 2022, the parties participated in an all-day mediation with Mark Feder, a respected mediator of wage and hour class actions.

Result

Analog Devices Inc. agreed to pay $2.5 million to settle the case.
