Facts

On November 4, 2020, Jorge Rodriguez filed a wage-and-hour lawsuit against his former employer, Imperial Western Products and others, in Riverside Superior. He sought to represent non-exempt, hourly employees who worked for Imperial between November 4, 2016 through April 29, 2022. On January 7, 2021, Rodriguez amended his complaint to include a Private Attorneys General Act violation. Eric Hernandez was later included as a plaintiff.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiff contended that defendant violated labor laws by failing to: pay minimum and overtime wages for all hours worked; provide employees with meal and rest breaks; timely pay all wages owed during each pay period and on termination; provide one day of rest in seven; reimburse business expenses; and provide employees with accurate, itemized wage statements and maintain accurate payroll records.

DEFENDANTS' CONTENTIONS: Defendants denied any liability or wrongdoing.

Settlement Discussions

On October 25, 2022, the parties participated in mediation with Daniel Turner and were able to come to an agreement.

Result

The parties settled for $635,000 to resolve all claims.
