Facts

Arianna Suarez and Irma Frausto were current and former nonexempt California employees at Bank of America. On January 25, 2018, Suarez filed a complaint in Alameda County Superior Court, while Frausto filed a complaint in February 22, 2018. The cases were removed to the United States District Court Northern District of California then related on July 11, 2018. The class in the case included Bank of America's current and former non-exempt employees who worked for Bank of America in California at any time from January 1, 2017, through October 31, 2022. Defendant estimated that there were 12,000 class members.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs alleged that defendant failed to: pay minimum and overtime wages for all hours worked, provide compliant meal periods and pay meal period premium wages, provide compliant rest breaks and pay rest break period premium wages, timely pay wages owed to employees during each pay period and upon termination, and provide accurate itemized wage statements for its California employees during the relevant time period.

DEFENDANT'S CONTENTIONS: Defendant denied all other contentions.

Settlement Discussions

On August 2, 2022, the parties participated in a mediation with Jeffrey Krivis, Esq., an experienced and well-respected class action mediator.

Result

Bank of America, N.A. agreed to pay $1,890,000 to settle all claims.
