Facts

On November 30, 2021, Silvia Perez, individually, and on behalf of all others similarly situated, brought a class action against Torn & Glasser Inc., alleging various Labor Code violations. The class included all non-exempt, hourly employees of Torn & Glasser Inc. who worked for them in California from November 30, 2017, to December 17, 2022. On February 7, 2022, Perez filed a First Amended Complaint adding a cause of action for civil penalties under the Private Attorneys General Act (PAGA). Based on a review of defendant's records prior to the mediation, defendant estimated there were 621 Class Members who collectively worked a total of 75,174 Workweeks, and 437 Aggrieved Employees who worked a total of 29,910 PAGA Pay Periods.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay minimum wages, pay overtime compensation, provide meal periods, authorize and permit rest breaks, timely pay final wages at termination, provide accurate itemized wage statements, and indemnify necessary business expenses for its non-exempt California employees during the class period.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Settlement Discussions

On October 18, 2022, the parties participated in an all-day mediation presided over by the Honorable Carl West (Retired) and reached an agreement.

Result

Torn & Glasser Inc. agreed to pay $1,127,610 to settle the case.
