Facts

On November 17, 2017, former tenant of L.A. Southpark High-Rise Juan Navarro, on behalf of himself and others similarly situated, brought a class action against L.A. Southpark High-Rise, LP for violations of the Civil Code and Business and Professions Code. The class included all persons who leased residential units from L.A. Southpark High-Rise, LP in California except those who were evicted, at any time from November 17, 2013, to December 16, 2019, who paid a security deposit to L.A. Southpark High-Rise, LP for a rental agreement for residential property in California and had any portion of their security deposit withheld by L.A. Southpark High-Rise, LP for cleaning, repair work, and/or late charges for rent. Based on a review of its records to date, L.A. Southpark estimated there were 468 Class Members who had a total amount of approximately $225,000 in security deposits withheld by L.A. Southpark for cleaning, repairs, or late rent charges as reflected on the Final Account Statement for all Class Members.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to issue legally compliant final account statements and improperly withheld security deposits for cleaning, repair, or late rent charges.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Settlement Discussions

On January 24, 2023, the parties participated in an all-day mediation presided over by Honorable Amy D. Hogue (Retired) which led to a settlement agreement.

Result

L.A. Southpark High-Rise, LP agreed to pay $535,000 to settle the case.
