Facts

Rami Amir is a member and manager of IP Investments, LLC. IP Investments is the owner of three parcels of land located at 805 West Cedar Street and 1560 California Street in San Diego.

The San Diego City Attorney filed suit on behalf of the People against IP Investments and Amir in San Diego County Superior Court.

Contentions

PLAINTIFF'S CONTENTIONS: The People contended that the property owned by the defendants constituted a public nuisance; that there were dangerous conditions on the property that posed an imminent threat to public health and safety; that structures on the property were supposed to be vacant, but were improperly secured, so it was frequently occupied; that police and fire department personnel regularly responded to calls about the property. The People specifically contended that the state of the property and structures violated multiple provisions of the Municipal Code and California Building Code.

DEFENDANT'S CONTENTIONS: The defendants denied any wrongdoing or liability and all the plaintiff's material allegations.

Result

The parties agreed to the entry of a stipulated judgment that requires IP Investments to demolish the buildings; and to pay $200,000 in civil penalties, $142,500 of which will be stayed if the rest of the stipulated terms are complied with. The judgment also requires IP Investments to secure the property and keep it free from trash until it is demolished.
