Facts

On June 10, 2022, Serena Lopez, on behalf of herself and all others similarly situated and on behalf of the general public, brought a class action against Invita Security CA Corporation, alleging wage and hour violations. The class included all former California employees of Invita Security CA Corporation who worked for Invita Security CA Corporation from June 10, 2019, to the date of preliminary approval. Based on a review of its records, Invita Security CA Corporation estimated there were 35,408 Workweeks during the class period. On August 16, 2022, Lopez filed a First Amended Complaint adding one cause of action for penalties under the Private Attorneys General Act.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: provide meal periods, provide rest periods, pay all wages, provide accurate itemized employee wage statements, timely pay wages due at termination, timely pay employees during employment, and reimburse for business expenses for its non-exempt California employees during the class period.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Settlement Discussions

On February 17, 2023, the parties participated in an all-day mediation presided over by Lisa Klerman which led to a settlement.

Result

Invita Security CA Corporation agreed to pay $830,000 to settle all claims.
