Facts

According to Phaedra Scott, she was walking by 350 Townsend Street in San Francisco when she was injured by a defective condition in the roadway. She then filed suit against the City and County of San Francisco on September 27,

2021 for negligence, failure to warn, and dangerous condition of public property.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff asserted that the defect caused her to step in a pot hole, causing inuries to various parts of her lower extremities and other issues.

DEFENDANT'S CONTENTIONS: Defendant generally denied all contentions. The Court dismissed plaintiff's causes of action for negligence and failure to warn because there was no statutory basis for them. The only remaining cause of action was the dangerous condition of public property

Result

The City and County of San Francisco Board of Supervisors authorized a settlement of $40,000.
