Facts

On Feb. 7, 2023, plaintiff Jorge Calderon, 77, was shopping at the 99 Cents Only Store in Moreno Valley, when he slipped on a liquid substance near the watermelon bin. Calderon hit his head and the left side of his body on the hard floor.

Plaintiff filed his lawsuit on April 12, 2023. Thereafter, plaintiff filed his CCP section 36 motion, which was granted and trial was scheduled for Oct. 16, 2023. After much written discovery, site inspection, depositions, two DME's and expert designation, defendant stipulated to liability but disputed the nature and extent of plaintiff's injuries. Defendant's motion to continue trial was successfully opposed, and the case settled after the FSC hearing.

Settlement Discussions

Plaintiff made a CCP 998 demand of $1.5 million policy limits. Defendant's initial offer was $100,000.

Result

Settlement of $1.4 million.
