On May 18, 2021, Mervin Perkins filed a class action suit in San Joaquin Superior against Pro Active Pest Control for wage-and-hour violations, seeking to represent non-exempt, or hourly employees who worked from July 9, 2017 to March 29, 2023.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiffs alleged causes of action for failing to: provide accurate, itemized wage statements; authorize and permit rest periods; provide meal periods; pay overtime, along with penalties under the Private Attorneys General Act.
DEFENDANT'S CONTENTIONS: Defendant did not admit, concede, or imply that its actions, as to plaintiff's purported allegations, were wrong or legally actionable.
