On April 27, 2022, Jose Arroyo, on behalf of himself, the State of California as a private attorney general, and all others similarly situated, brought a class action against AFP Advanced Food Products LLC (AFP), alleging various wage and hour violations. The class included all individuals who are or were employed by AFP as non-exempt employees in California from April 27, 2018, through March 31, 2023.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay minimum wages for all hours worked, pay proper overtime wages, provide compliant rest periods and pay missed rest break premiums, provide compliant meal periods and pay missed meal period premiums, maintain accurate employment records, pay timely wages during employment and at separation, pay sick leave, and provide complete and accurate wage statements for its California employees during the class period.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Settlement Discussions
On December 6, 2022, the Parties participated in an all-day mediation presided over by Steve Pearl, Esq., which led to a settlement agreement.
Result
AFP Advanced Food Products LLC agreed to pay $495,000 to settle all claims.
