Facts

On April 5, 2019, Maria Hernandez filed suit individually and on behalf of all others similarly situated against Blue and Yellow Taxi Group, Inc., L.A. Checker Cab Company, Inc., and Global Paratransit, Inc. in Los Angeles County Superior Court.

Contentions

PLAINTIFF'S CONTENTIONS: Hernandez contended that she and other alleged class members were nonexempt hourly employees of Blue and Yellow, L.A. Checker Cab, and Global Paratransit; and that some employees had been misclassified by Global Paratransit as independent contractors. Hernandez also contended that the defendants failed to provide meal periods and rest breaks; failed to pay overtime wages; failed to pay minimum wages; failed to pay all wages due upon separation from employment; failed to maintain required records; failed to furnish accurate itemized wage statements; failed to reimburse necessary business expenses; and were liable for civil penalties under the Private Attorneys General Act of 2004.

DEFENDANTS' CONTENTIONS: The defendants denied any wrongdoing or liability and all the plaintiff's material allegations.

Result

The parties reached an agreement wherein the defendants admitted no wrongdoing or liability but agreed to pay $350,000 to settle class and PAGA claims.
