Facts

On August 24, 2021, Ryan Gentile, individually and on behalf of all others similarly situated, brought a class action against Homeside Financial LLC, alleging various Labor Code violations. The class included all current and former non-exempt employees who are or were employed by defendant in California at any time from August 2020 through October 14, 2022. Homeside Financial estimated there were 4,700 workweeks worked for defendant during the class period.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: pay all regular wages, minimum wages, piece-rate wages, commission wages, and overtime wages due; pay wages to piece-rate or commission workers for time spent in rest breaks or recovery period or non-productive time; provide proper meal periods, and to properly provide premium pay in lieu thereof; and failure to provide complete, accurate, and/or properly formatted wage statements for its non-exempt California employees during the class period.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Homeside Financial LLC agreed to pay $376,000 to settle the case.
