Facts

Fabrique Innovations, a New York corporation, contracted with Etiwanda Logistics to store certain sports logo-branded products in Etiwanda's leased California warehouse. Fabrique later sued Etiwanda in USDC Eastern for, among others, breach of contract, conversion, and violation of Commercial Code Section 7210, seeking, in part, to stop Fabrique from auctioning its goods.

According to defendant, though the parties had a letter agreement dated January 18, 2019, that agreement was modified on October 31, 2019 by subsequent emails allowing Fabrique to store the goods in Etiwanda's leased property until January 1, 2020, but Fabrique only completely removed the goods several months later on August 31, 2020.

Result

The parties settled with plaintiff agreeing to pay $110,000 to defendant.
