Facts

Sima Adami, in her representative capacity on behalf of the State of California, the general public, and all aggrieved employees, brought a class and representative action against Prime Now LLC, alleging various Labor Code. The class included all employees who performed work for defendant in California at any time from March 18, 2020, through July 5, 2021, and underwent one or more COVID-10 temperature screenings.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendants failed to: timely compensate for all hours worked, including minimum, regular, and/or overtime wages; pay all wages due and owning upon separation of employment and/or mandatory waiting time penalties; furnish accurate itemized wage statements; and maintain accurate employee records for its non-exempt California employees during the class period.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Settlement Discussions

On April 27, 2023, the parties participated in a mediation with Lisa Klerman, Esq., an experienced and well-respected class action mediator.

Result

Prime Now LLC agreed to pay $4.3 million.
