On April 3, 2020, Jorge Almanzar, on behalf of himself and all others similarly situated, brought a class action against Home Depot U.S.A. Inc., alleging various Labor Code violations. The class included all current and former non-exempt, hourly Night Team Merchandising Executive Associates who worked for Home Depot in California between April 3, 2016, and November 1, 2021.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant failed to: provide compliant meal periods, provide compliant rest periods, pay overtime wages, reimburse necessarily incurred business expenses, timely pay all wages due upon termination, furnish timely and accurate wage statements to non-exempt California employees during the class period.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
Home Depot U.S.A. Inc. agreed to pay $750,000 to settle all claims.
