On June 22, 2022, former employee Anthony Morris, on behalf of himself and all others similarly situated, brought a class action against The Lincoln National Life Insurance Company, Lincoln National Corporation, alleging various Labor Code violations. There were two classes. "Class I" meant all persons employed by Defendants (exempt and nonexempt) in California who worked from home pursuant to Defendants' alleged policy or practice requiring them to do so from June 22, 2018, to May 17, 2023. "Class II" meant all persons employed by Defendants in California as non-exempt employees from June 22, 2018, to May 17, 2023. Based on a review of its records to date, defendants estimated there are approximately 231 Class Members who collectively worked a total of approximately 27,662 Workweeks through January 23, 2023, and approximately 179 Aggrieved Employees who worked a total of approximately 5,124 Private Attorney General Act Period Pay Periods through January 23, 2023.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendants failed to: reimburse business expenses, pay all wages, pay overtime wages, provide compliant meal periods, provide compliant rest periods, provide accurate itemized wage statements, provide sick pay, and timely pay all wages during employment and upon separation of employment for its nonexempt California employees during the class period.
DEFENDANTS' CONTENTIONS: Defendants denied all contentions.
Settlement Discussions
On February 16, 2023, the parties participated in a day mediation presided over by Lou Marlin, Esq.
Result
Defendants agreed to pay $500,000 to settle the case.
