Plaintiff Miriam Green brought this consolidated class action for writ of mandate, declaratory judgment, and refunds of gas and electric fees imposed by defendant, the City of Palo Alto. Class certification was granted.

Result

The settlement provided a common fund of $17,337,111, from which refunds would be paid to the City's gas utility retail customers. The court approved $85,000 in administrative fees; attorneys fees of $4,319,720.10; and a class representative award for plaintiff of $7,500.
