On November 21, 2022, Mercedes Castro, individually and on behalf of all similarly situated individuals, brought a class action against Reseda Discount Corporation and RDC Collective Corp., alleging various Labor Code and Private Attorneys General Act (PAGA) violations. The class included all persons who worked at least one shift as a non-exempt employee in the State of California for Reseda Discount Corporation and/or RDC Collective Corp., under CA Department of Cannabis Control license #CDPH-10003587 or CDPH-T00000842, from November 21, 2018 to July 31, 2023.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendants failed to: pay minimum wages, pay overtime wages, provide meal periods of premium pay in lieu thereof, reimburse necessary business expenses, provide and maintain complete and accurate records, timely pay wages during employment, and timely pay wages after employment for its non-exempt California employees during the class period.
DEFENDANTS' CONTENTIONS: Defendants denied all contentions.
Settlement Discussions
On June 8, 2023, the Parties participated in a full-day mediation before David L. Perrault of Judicate West, a well-respected mediator in the field of employment law and wage and hour class and PAGA actions.
Result
Defendants agreed to pay $140,000 to settle all claims.
