Facts
On March 26, 2014, Kanwar Mahal purchased a brand new 2014 Tesla Model S from Tesla Motors Inc. for his personal and family use. On April 28, 2022, Mahal sued Tesla Motors in Fresno Superior for violations of the Song-Beverly Consumer Warranty Act. The case was later removed to the USDC Eastern by Tesla Motors.
Contentions
PLAINTIFF’S CONTENTIONS: Plaintiff contended that since purchasing the vehicle, he had to take it in for repairs no less than three times due to defects including: buzzing/electric noise when driving at low speeds; illumination of the low power warning light, acceleration reduced alerts, and car in need of service warning light; the vehicle not starting; and the vehicle not driving.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
The case settled. Defendant Tesla agreed to pay plaintiff $55,954.16 along with $8,500 in attorneys' fees and costs to settle the claim. In return, plaintiff agreed to surrender the vehicle.
