Facts

Plaintiff Christopher K. Alonso brought a Section 1983 action against the City of El Centro and several of its police officers, alleging that they violated his Fourth and First Amendment rights after he was arrested following a heated verbal exchange at a 7-Eleven. He also alleged a state law claim for slander against the City and the individual El Centro police officers. Defendants moved to dismiss, asserting, among other things that Plaintiff failed to state a claim.

Result

The court dismissed the claims, finding that Plaintiff failed adequately allege how the City violated Plaintiff's Constitutional rights.
