Facts

On April 11, 2018, Cathryn-Lucy Price, on behalf of herself and all others similarly situated, filed a class action against AMN Healthcare, Inc. and AMN Services, LLC. On January 10, 2019, Price filed a second amended class action complaint adding Michelle Pono as a plaintiff. On June 25, 2021, Price and Pono filed the operative third amended class action complaint. The class included all current and former California based non-exempt employees who worked for AMN as Credentialing Analysts from April 11, 2014, through preliminary approval and/or Customer Account Managers from January 8, 2015, through date of approval.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs alleged that defendants failed to: pay minimum and overtime wages for time worked but not paid, provide compliant meal periods and associated premiums, provide compliant rest periods and associated premiums, provide all wages at time of termination, and provide compliant wage statements for its non-exempt California employees during the class period.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Settlement Discussions

On January 10, 2020, the parties, by and through their respective counsel, engaged in a full-day private mediation with Hon. Ronald M. Sabraw (Retired).

Result

Defendants agreed to pay $600,000 to settle all claims.
