Facts

On May 14, 2020, Nancy Garcia, individually and on behalf of all others similarly situated, brought a class action against Common Area Maintenance Services Inc., dba Cam Services Inc., Cam Property Services Inc., and David Herrera, alleging various Labor Code violations. On July 15, 2020, Garcia filed a first amended complaint adding a cause of action under the Private Attorneys General Act. The class included all current and former non-exempt employees who have worked for CAM Property Services, Inc. in California from May 14, 2016, through the date of preliminary approval. As of January 18, 2022, defendants represented that there were approximately 11,451 workweeks during the class period.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendants failed to: pay overtime wages, provide meal periods or premium compensation in lieu thereof, provide rest periods or premium compensation in lieu thereof, furnish accurate itemized wage statements, pay all wages earned, maintain required payroll records, and pay earned wages upon termination for its non-exempt California employees during the class period.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Settlement Discussions

The parties participated in a global mediation with an experienced and well-known employment/wage and hour mediator, Michael Young.

Result

Defendants agreed to pay $375,000 to settle all claims.
