Facts
Los Angeles Waterkeeper, a California non-profit association, filed an action against defendant Astro Pak Corporation, which owns and operates an industrial facility in Downey, California. LA Waterkeeper alleged that defendant's operations at the facility resulted in discharges of pollutants into U.S. waters in violation of the Clean Water Act. The parties stipulated to a consent decree.
Result
Under the consent decree, defendant agreed to: adopt an action plan to control storm water pollution; consent to compliance, monitoring, and reporting procedures; and partially defray costs associated with plaintiff's monitoring of defendant's compliance by paying $3,000. Defendant also agreed to pay $5,000 to the Rose Foundation to fund environmental project activities that reduce or mitigate the impacts of storm water pollution from industrial activities. Finally, defendant agreed to pay $30,000 to LA Waterkeeper to partially reimburse its investigation costs and attorneys' fees.
