Facts

On April 27, 2022, Angela and Stoney Earthman sued FCA US and Surf City Auto Group dba Huntington Beach CDJ Ram in Orange County Superior. The Earthmans asserted causes of action for, among others, breaches of warranty based on their purchase of a 2017 Dodge Durango. On December 5, 2022, the Earthmans dismissed Huntington Beach CDJ.

Contentions

PLAINTIFFS' CONTENTIONS: According to plaintiffs, at the time they purchased the vehicle, the mileage was 59. When they first encountered issues at about 22,659 miles, they took the vehicle in for repairs to Huntington Beach CDJ. Repeated attempts to fix various issues went unresolved.

Result

The case settled for $160,539.
