Facts

On February 7, 2023, Pipe Restoration Technologies and ACE Duraflo Systems sued Ronald Coddington and Florida Drain-Lining Solutions for causes of action related to the copyrights and trademarks owned by plaintiffs.

Contentions

PLAINTIFFS' CONTENTIONS: Plaintiffs argued, in part, that though they licensed their intellectual property to defendant Coddington's company, Florida Drain-Lining, defendant Coddington started a new business which adopted and used the intellectual property licensed to Florida Drain-Lining while falsely advertising that the new company was associated with Florida Drain-Lining. Essentially, it was undisputed that defendant Coddington lifted plaintiffs' intellectual property, placing them on defendant Florida Drain's website.

DEFENDANTS' CONTENTIONS: Defendants denied all material contentions.

Settlement Discussions

The parties participated in mediation with John Sommer and agreed to settle.

Result

The case settled by stipulated judgment. Defendant was enjoined using Plaintiffs' trademarks, using Plaintiffs' copyrighted materials, and stating or implying that Defendants are affiliated with Plaintiffs.
