Los Angeles Waterkeeper, a California non-profit association, brought a complaint alleging that defendant Tell Steel Inc., which owns and operates an industrial facility in Long Beach, violated the Clean Water Act and other environmental regulations due to its discharge of pollutants into storm drains and surface waters. The parties entered into a consent decree.
Result
Under the consent decree, the parties agreed that defendant would adopt storm water pollution control best management practices; consent to compliance monitoring and reporting procedures; and partially defray costs associated with plaintiff's monitoring by paying $5,000.00. Defendant also agreed to pay $35,000 to the Rose Foundation to fund environmental project activities that will reduce or mitigate the impacts of storm water pollution from industrial activities. Finally, it agreed to pay $95,000 to LA Waterkeeper to partially reimburse its investigation costs and attorneys' fees.
