Facts
In February 2023, the Los Angeles City Council adopted ordinances, Ordinance No. 187763 and 187764, amending existing city ordinances allowing landlords to initiate unlawful detainer actions based on tenants' inability to rent based on the amount due exceeding the fair market rent for equivalent-sized rental units in the Los Angeles area and payment relocation assistance. The Apartment Association of Los Angeles County dba Apartment Association of Greater Los Angeles (AAGLA) then petitioned for a writ on March 3, 2023, challenging the City's adoption of the Ordinances. According to petitioner, the ordinances were preempted by state laws, including the Costa-Hawkins Act. Respondents argued that there was no conflict between the Act and the Ordinances.
Result
The court denied petitioner's writ request.
