After the Equal Employment Opportunity Commission (EEOC) investigated staffing agency BaronHR LLC, determining it violated disability and discrimination laws, after attempting to settle, it filed suit in USDC Central.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff asserted that defendant required applicants to be free of medical conditions or have no history of injury, resulting in excluding qualified individuals with disabilities, perceived disabilities or a record of disability. Moreover, plaintiff contended that defendant also failed to recruit and refer workers based on their race or national origin.

DEFENDANT'S CONTENTIONS: Defendant denied all material allegations.

Result

The case settled. Defendant will pay $2.2 million while also consenting to certain injunctive remedies, including: changing its employment practices to prevent future discriminatory hiring; retaining a third-party monitor, training its staff and management; employing reporting mechanisms; and updating anti-discrimination policies.
