Facts

On January 16, 2020, Ahmet Alkanli was driving his vehicle in the rain when he lost control of the vehicle and collided with a light pole. The pole fell on top of Alkanli's vehicle, and he suffered injuries as a result of the crash.

On December 23, 2020, Alkanli filed suit against, among other defendants, the City of Los Angeles in Los Angeles County Superior Court.

Contentions

PLAINTIFF'S CONTENTIONS: Alkanli contended that his car accident was a result of the City's negligence in maintaining the roadway and light pole. Specifically, Alkanli contended that public employees were negligent, and the City was liable for its employees' alleged negligence. Moreover, Alkanli contended that Los Angeles had maintained public property in a dangerous condition, which contributed to his injuries.

DEFENDANT'S CONTENTIONS: The City of Los Angeles denied any wrongdoing or liability. The City further contended that Alkanli was driving his vehicle at an excessive rate of speed which caused it to skid off the roadway and crash, and it also argued that it and its employees were immune from liability as a
matter of law.

Result

The court granted summary judgment in favor of the City of Los Angeles.
