Facts

On July 26, 2021, Miguel Alarcon filed a class action lawsuit in Tulare Superior against CT Commodities for wage-and-hour violations while seeking Private Attorneys General Act (PAGA) penalties. The class period included the timeframe from January 29, 2017 through and including August 27, 2022; while the PAGA period was from November 3, 2019 through and including August 27, 2022.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff asserted claims pertaining to: inaccurate itemized wage statements; failure to separately compensate rest period time; failure to provide meal periods; failure to pay meal period premiums; failure to pay all wages due on separation from employment; and, unreimbursed expenses.

DEFENDANT'S CONTENTIONS: Defendant denied all allegations asserted in plaintiff's complaint.

Result

On January 18, 2024, the Court approved the non-reversionary settlement amount of $306,887, with payment of $107,410.28 in attorneys' fees from the gross settlement fund and $7,025.91 for costs.
