Facts

In 2019, Plaintiff Ibrahim Nimer Shiheiber stopped his car briefly in a red zone outside a sandwich shop in San Francisco; as he walked towards the sandwich shop, SFPD Officer Brett Hernandez and his partner approached Plaintiff and told him he was being detained for stopping in a red zone. When Plaintiff offered to move the car, Hernandez pushed him and patted him down for weapons. Hernandez then slammed Plaintiff to the ground and kneeled on his back, causing severe pain. Plaintiff filed suit alleging excessive use of force, as well as a Fourth Amendment violation. He also alleged that the police department personnel were deliberately evasive and unhelpful as he attempted to lodge an officer complaint.

Result

San Francisco approved a settlement amount of $50,000.
