Jonathan Lopez, individually, and on behalf of other members of the general public similarly situated, brought a class action against National Business Investigations, Inc. d/b/a MPS Security, alleging Labor Code violations. The class included those individuals who are or were employed by Defendant as Security Officers and similar non-exempt hourly positions within the State of California any time between January 21, 2016 and August 16, 23 2023.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiffs alleged that defendant failed to: pay earned wages; provide accurate, itemized wage statements; provide compliant rest breaks; provide compliant duty-free meal breaks; pay compliant premiums as a result of violated rest and meal breaks; and accurately record hours worked and wages earned.
DEFENDANT'S CONTENTIONS: Defendant denied all contentions.
Result
National Business Investigations agreed, without admitting wrongdoing, to pay $300,000 to settle all claims, less a class service award of $10,000 to Jonathan Lopez, a $10,000 PAGA penalty, $120,000 in attorneys' fees, $28,397.04 in costs, and $14,000 in settlement administration costs.
