Facts

On May 27, 2021, Martha Lizaola, individually, and on behalf of other members of the general public similarly situated, brought a class action against Hawaiian Host Candies of LA, Inc., alleging a pattern and practice of wage abuse and violations of the Labor Code. The class included current and former non-exempt employees who worked for Defendant in California from May 27, 2017 until August 17, 2022.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiffs alleged that Defendant engaged in unfair business practices and failed to: pay earned wages, including minimum wages and overtime wages; provide accurate, itemized wage statements; provide compliant rest breaks; provide compliant duty-free meal breaks; pay compliant premiums as a result of violated rest and meal breaks; accurately record hours worked and wages earned; and pay wages due at separation in a timely fashion.

DEFENDANT'S CONTENTIONS: Defendant denied all contentions.

Result

Hawaiian Host Candies agreed, without admitting wrongdoing or liability, to pay $140,000 to settle all claims, less a class service awards of $7,500 to Martha Lizaola, a $7,500 PAGA penalty, $46,666.66 in attorneys' fees, $10,795.71 in costs, and $5,500 in settlement administration costs.
