Francisco Hernandez sued his former employer, Baltazar Construction Inc., alleging wage-and-hour violations. He also added an additional cause of action seeking Private Attorneys General Act penalties.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff asserted that defendant failed to: pay all regular, minimum, prevailing, and overtime wages; provide meal and rest periods or compensation in lieu of; reimburse necessary business expenses; provide complete, accurate wage statements; pay wages timely on termination or resignation; provide timely pay wages during employment; and maintain required payroll records.

DEFENDANT'S CONTENTIONS: Defendant denied all material contentions, contending it complied with applicable laws.

Result

The parties settled for $540,000. Defendant had already paid $91,000 prior and thus, its balance was $448,500. Class counsel would receive $180,000 in fees and $14,700.78 for litigation costs. Finally, all employer taxes were to be paid by defendant separately.
