Facts

From December 28, 2018 to March 9, 2021, Alexander Nejat was employed by MTN Inc. Environment Services as a non-exempt, hourly general laborer. On March 7, 2022, he filed a class action complaint in Santa Clara Superior against MTN for wage-and-hour violations.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff asserted the following causes of action: failure to pay minimum and overtime wages; failure to provide meal and rest periods or compensate in lieu of; failure to provide accurate wage statements; failure to pay wages on termination from employment; and claims under the Private Attorneys General Act.

DEFENDANT'S CONTENTIONS: Defendant denied all material allegations, maintaining it complied with applicable laws.

Result

The parties settled for $206,500 of which one-third would be allocated for attorney fees.
