Facts

Plaintiff Marc Ritson brought an action against the County of Santa Cruz et al relating to sewage disposal designs in conjunction with its Local Area Management Plan, alleging negligence and violations of the Business and Professions Code.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that Defendants engaged in negligent conduct regarding project plans requiring ATU designs and distribution box designs as well as violated state constitutional and statutory requirements for the Business and Professions Code for licensing and practice of civil engineers.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Result

Defendant's demurrer was sustained without leave to amend. The court noted that, even with leave to amend, Plaintiff failed to state how these designs negatively impacted his practice as a civil engineer.
