Facts

On November 11, 2022, Plaintiff GS Holistic brought an action against Defendants Bro's Inc d/b/a Bro's Smoke 4Less, et. al, alleging Defendants had sold glass infusers bearing counterfeit marks imitating trademarks owned by Plaintiff in violation of the Lanham Act.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff alleged that Defendants used Plaintiff's marks, including marks that were identical or substantially indistinguishable, in commerce in such a way that is intended to cause confusion in the minds of the public resulting in Plaintiff's lost profits.

DEFENDANTS' CONTENTIONS: Defendants denied all contentions.

Result

Judgment entered in favor of Plaintiff on all claims and Defendants were liable for $50,000 in damages. Defendants were also permanently restrained and enjoined from infringing upon Plaintiff's marks directly or contributorily, in any manner.
